This Privacy Policy explains what personal information TryOut collects, why, who we share it with, and the choices and rights you have. TryOut ("the app", "we", "us") is operated by Matyss De Montella. By using the app you agree to the practices described here.
TryOut's core feature is virtual try-on. To make it work, you provide photographs of yourself: including selfies (your face) and full-body photos, and photographs of clothing items. We treat these images as sensitive and describe below exactly how they are used, shared, stored, and deleted. We never use your photos to identify you biometrically, to build facial-recognition systems, or for advertising, and we never sell them.
Our legal bases (where the GDPR applies) are: performance of a contract (providing the app you signed up for), your consent (processing the photos you choose to upload), our legitimate interests (security, abuse prevention, product improvement), and legal obligation.
Some features, in particular creating your avatar and try-on images from your photos, cannot run on your device and are carried out on external servers. To provide the app, we share only the data necessary to deliver the service with the third-party providers named below, each of which processes it on our behalf, under our instructions, and solely to operate TryOut.
Your photos are sent to third-party AI services to be processed. Photos only ever leave your device when you actively submit them in the app — when you confirm creating your avatar, or when you add a garment photo. Nothing is uploaded in the background, and if you never submit a photo, none is sent; the avatar and try-on features simply remain unavailable to you.
These providers act as processors: they process your images to return a result to us and are not permitted to use them for their own purposes.
Equal protection. Each third party listed above with whom we share user data — including any parent, subsidiary, or related entity of theirs that has access to it — is bound by contractual terms requiring it to provide the same or equal protection of your data as is stated in this Privacy Policy and required by the App Store Review Guidelines.
We do not sell your personal information and do not share it for third-party advertising. We may disclose information if required by law or to protect our rights, users, or the public.
Your data is stored in our cloud backend under access controls that scope each user's files and records to that user. We use industry-standard measures to protect it in transit and at rest. Because our providers operate globally, your information may be processed in countries outside your own, including outside the European Economic Area; where that happens we rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses.
Withdrawing your consent to AI processing. You give this consent by actively submitting your photos in the app (section 4); if you never submit any, none is sent and the rest of the app keeps working. To withdraw it afterwards, delete your account in the app (Settings → Delete account), which erases your photos, avatar, and try-on layers, or email us at the address below and we will erase them for you. Once withdrawn, no further photos of yours are sent to any AI provider.
You can delete your account and associated data at any time from within the app (Settings → Delete account), which removes your stored photos, avatar, wardrobe, and account record.
Depending on where you live (and in full where the GDPR applies), you also have the right to: access the data we hold about you; correct it; erase it; restrict or object to processing; withdraw consent; and receive a portable copy. To exercise any of these, or if you have questions, contact us at [email protected]. You also have the right to lodge a complaint with your local data-protection authority.
TryOut is not directed to children and is not intended for anyone under 13 (or the minimum age of digital consent in your country, whichever is higher). We do not knowingly collect data from children; if you believe a child has provided us data, contact us and we will delete it.
We may update this Privacy Policy as the app evolves. We will change the "Last updated" date above and, for material changes, provide a more prominent notice.

These Terms of Use ("Terms") are a legal agreement between you and Matyss De Montella ("we", "us") governing your use of the TryOut mobile application. By downloading, accessing, or using TryOut, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app.
You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) and able to form a binding contract to use TryOut.
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use TryOut for your own non-commercial use, subject to these Terms and Apple's App Store terms. You may not copy, modify, reverse-engineer, resell, or exploit the app except as the law expressly permits.
You keep ownership of the photos and content you upload ("Your Content"). You grant us a limited licence to host, process, and transform Your Content solely to operate the app for you, for example, to generate your avatar and try-on images through the providers listed in our Privacy Policy. You represent that you have the right to upload the content you provide and that it does not infringe anyone's rights.
You agree not to: upload photos of anyone without their consent; upload unlawful, infringing, or harmful content; attempt to disrupt, overload, or gain unauthorized access to the service; use the app to build a competing dataset or model; or misuse it in any way that violates law or these Terms.
TryOut offers a free tier with usage limits and an optional paid subscription ("TryOut Pro") that unlocks higher limits. Subscriptions are auto-renewable and sold through the Apple App Store. By subscribing you agree that:
Avatars and try-on images are generated automatically by AI. They are approximations for visualization and styling only; they may contain inaccuracies and are not a guarantee of how a garment will actually look, fit, or be colored on you. TryOut is not affiliated with, and does not represent, the brands or garments you photograph.
The app, its name, design, and software are owned by us and our licensors and are protected by law. These Terms grant you no rights in our trademarks or branding.
The app is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the app will be uninterrupted, error-free, or that generated results will meet your expectations.
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the app. Nothing in these Terms limits liability that cannot be limited under applicable law (including, where relevant, your statutory consumer rights).
You may stop using the app and delete your account at any time. We may suspend or terminate your access if you breach these Terms or to protect the service or other users. Provisions that by their nature should survive (e.g. ownership, disclaimers, limitation of liability) survive termination.
We may update these Terms as the app changes. We will update the "Last updated" date and, for material changes, provide a more prominent notice. Continued use after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of France, and the courts of Toulouse, France shall have jurisdiction, without regard to conflict-of-laws rules and subject to any mandatory consumer protections of your country of residence.
These Terms are between you and us only, not with Apple; Apple is not responsible for the app or its content. The licence granted is limited to using TryOut on Apple-branded devices you own or control, per the App Store Usage Rules. We (not Apple) are solely responsible for the app, its maintenance and support, any product warranties, and addressing any claims relating to the app (including product-liability, legal or regulatory, and intellectual-property claims). You represent that you are not in a country subject to a U.S. Government embargo or designated as "terrorist-supporting", and are not on any U.S. Government restricted-parties list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
